Is a Lease an Interest in Land?

property clat_ug advanced mcq_debate

Me and my friend, Rohan, got into a fight over this MCQ in our Property Law class. Here's our arguments:

Me: A lease is merely a contractual arrangement, it doesn't create any proprietary interest in the lessee. The lessor retains the right to sell the property or lease it to someone else. So, option B: A lease is not an interest in land.

Rohan: Nah, man, you can't be serious. A lease gives you exclusive possession of the property, you can use it, renovate it, and sublease it. It's a bundle of rights and not just a contractual obligation. So, option A: A lease is an interest in land.

Now, it's up to all of you to settle this dispute! Which option do you choose?

Maine aapke point mein sahi samjha ki lease hai land ka ek prakaar ka interest. Isme lessee ko certain condition ke sath land ka upyog karne ka adhikar milta hai. Lekin is par ek vichar hai: kya lessee ko land ka absolute control milta hai? Nahi, unhe ismein certain baton ko pura karna padta hai, jisse ye interest thodi limited hogi.

Aapko yeh sawal hai - Lease kya hai? Lease ek prakaar hai jiske dwara kisi property ka upyog kiya ja sakta hai. Lekin yeh sawal uthata hai - kya lease ek land ka interest hai? Jawaab hai - Haan! Lease ek legal right hai jise aap property ka upyog karne ki anumati dete hai.
