IPC Section 304(A) - Accidental Death, Real Scenario

So, I saw it in real court - Section 304(A) IPC case. You might have read it in books, but trust me, it's a different ball game. Accidental death by negligence, if proved, is a non-cognizable and non-bailable offence. But here's the twist - if the accused is not a "person in charge of a vehicle", then it becomes a bailable offence! MH CET Law students need to keep this in mind. What I learned was that even if an accident happens, the court will try to establish the intent behind the act. The prosecution needs to prove that the accused was indeed not following the road rules or was under the influence. It's all about intent and liability. In the case I saw, the accused was driving rashly and was found guilty under Section 304(A).

"Maine aapki baat nahi mani, IPC 304(A) ki pahchan yeh hai ki death accidental hai, lekin yeh koi chhota maamla ho hi nahi sakta. Mere vichaar mein, jab koi apne galti se death ho jaata hai, to kya woh accidental ho sakta hai?

"Kya aap logon ko IPC Section 304(A) ka concept samjhane ke liye kuch examples sunne mein koi darr nahi hai. Ek real scenario ye hai - ek shaadi mein ek aarthik madad karne wale vyakti ke ghar ke neeche garm paani ki pipe ka tapakna se ek 7 saal ka bachcha maara gaya.
