IPC Section 300: Culpable Homicide or Murder?

But seriously, is IPC Section 300 an exception to murder (Section 299) or a separate cognizable offence? I think it's the former. It defines culpable homicide as an act done with the intention of causing death or with the knowledge that it may cause death, but without the mens rea for murder. Agar aapko lagta hai ki murder aur culpable homicide dono separate hain, toh kya aap Section 300 ka sabse bada faida ya nuksan utha rahe hain?

Section 300 ka sabse bada kaam yeh karna hoga ki hamaare samaj ko yeh samajhane me madad karta hai ki kiske case me culpable homicide murder ke hi hai. Agar mansikta hai ya intention hai ki koi khatra padi hai, to murder ho jata h. Vichar hai ki IPC 300 ke 5th explanation me iska dhyan diya gaya hai. Lekin, court ke case-by-case evaluation par nirbhar karta hoga.
