IP Law: Where Originality is Overrated

I think the CLAT PG curriculum overemphasizes originality as a criterion for patentability. In my opinion, this approach neglects the reality of innovation, where building upon existing ideas is often the norm. By prioritizing originality, we risk stifling genuine progress in certain fields. For instance, consider the numerous improvements made to existing technologies in the medical field. These advancements often rely on modifying or combining existing ideas, rather than creating a groundbreaking new concept. This is especially true in biotechnology, where researchers frequently build upon the discoveries of others to develop life-saving treatments. By recognizing the importance of incremental innovation, IP law can be more accommodating of the complex, collaborative nature of scientific progress.
