IP Law: Mock Test Experience

ipr judiciary beginner experience_share

I was stuck on question 8 - "Distinguish between the concept of 'patent' and 'utility patent'." - for a full 5 minutes in the mock test yesterday. I remembered studying the Patent Act, 1970 and keeping in mind Art 2(f) - "inventions not capable of being applied in industry and are not capable of being used for industrial purposes", but still got the marks for only one option. Luckily, the examiner accepted my "Utility Patent is a type of patent, not a standalone invention" explanation. The question was from the IPC, so I was a bit worried. But later, when I checked my notes, I realized it was actually Art 2(f) of the Patent Act and I shouldn't have gotten so worked up.
