Intra-State CPC Jurisdiction: A Hidden Gem

cpc general intermediate internship_learn

During my internship in a Mumbai law firm, I stumbled upon a fascinating aspect of the Civil Procedure Code (CPC) that my textbooks conveniently omitted. In Article 20 of Order XIII, it's stated that the courts in Bombay (now Mumbai) have jurisdiction over suits filed against non-resident Indians when the cause of action is situated within the state. What my textbooks didn't mention is that this provision applies to all states, not just Bombay! It's a crucial clause that can make all the difference in cases where the cause of action is uncertain or disputed. For example, in a case where a tenant from Delhi is in a dispute with a property owner in Kolkata, if the cause of action arose from a contract signed in Delhi, the Kolkata court could still have jurisdiction under this provision. It's a valuable insight that can help students and practitioners navigate the complexities of intra-state CPC jurisdiction.
