It's based on the assumption that certain terms and conditions are automatically accepted by a party merely by virtue of their participation in a process or activity. This is not only unjust but also creates uncertainty and ambiguity in contractual agreements.
In my opinion, parties should explicitly agree to terms and conditions before they become binding. Anything less is a recipe for disputes and litigation. I'd like to know, what's your take on this? Do you think implied consent has its place in contract law or should it be scrapped altogether?
