Identifying Offences and Principles of Abetment
cpc general advanced pyq_discussionMaine socha tha I understand Contract, and then the paper happened ๐. But one question that still haunts me is from previous year: "Rohan, with the intention of causing death, encouraged and provoked Suhel to commit murder. However, Suhel, without any intention to kill, committed murder in the heat of the moment. Rohan also gave false evidence in court. Identify the offence committed by each person".
Correct approach karna hoga: Abetment ka concept samajhna hoga. Suhel ko koi intention to kill nahin thi, but he committed murder, toh woh IPC Section 299 ka offence ka hoga, murder in the heat of the moment. Lekin Rohan ne abetment ka act kiya, aur false evidence diya, toh unka offence IPC Section 114 aur 193 ka hoga.

Bhai, I don't think abetment should be included as a distinct principle. It's just a form of assistance or encouragement to commit an offence. S 107 IPC already covers it. Focusing on abetment as a separate principle can lead to unnecessary complications in cases like inciting riots or hate speeches. Let's keep it simple, na?
