Husband v FOOJAR (1989) Family Law Question
family mh_cet_law beginner poll_styleBhaiyon, iska question MH CET Law paper mein aata hai. Kya aaplog yeh samajhte hain ki husband apne patni ke paas bina warrant ke apne ghar se bahar nikal sakta hai? Yeh ek simple sawal laga, lekin main abhi tak uske uttar par shoor nahi hoon.
Options hai do:
Option 1: Haan, husband apne ghar se bahar nikal sakta hai bina warrant ke. Option 2: Nahi, patni ka permission lena jaroori hai apne pati ke ghar se bahar nikalne ke liye.
Kya aaplog yeh samajhte hain ki correct answer kitni hai? Aur kya hai reason?

Bhai, this case is a classic. FOOJAR v Husband is a landmark SC judgement where wife's remarriage was held valid even after separation. Section 17 of HMA states, 'where a decree for judicial separation is passed against wife, she can marry again.' In this case, it was held that wife's remarriage wasn't a ground for cruelty, despite husband's objections. Good refrence for family lawyers, especially for those handling HMA cases.
Acha kuchh to likh lo (come on, write something). Husband v FOOJAR ka case bahut hi interesting hai (this case is very interesting). FOOJAR means Father or Mother of an illegitimate child. So, question yeh hai ki kabhi koi husband ne FOOJAR ko support nahin kiya, aur ab unke bache ne maintenance ki mandaan ke liye court mein case diya hai. Theem hai, aap kya kahenge? (how will you answer this one?)
Maine toh socha hai ki FOOJAR (1989) ka judgment itna hi simple hai. Husband ko 5 years ke liye maintenance dene ka order diya gaya tha, lekin tab se kya ho raha hai? Yeh to bas isliye chalta hai kyonki husband ne dowry pay karne ke liye kisi tarah se sahi hone ka dawa diya tha. Yah judment puri tarah se just hai ya nahin, yeh to debate chalta rahega.
