Guys, CLAT UG prep ke liye kuch sawaal aur aaye hai. Inme se ek Family Law ka hai. Aap sabhi ka feedback chahiye.

In the Hindu Marriage Act, 1955, a wife can file for divorce on the ground of 'desertion' (U/s 13(1)(ia)). Now, if a husband and wife separate due to the husband's infidelity, but the wife is 'tolerating' the situation, can the wife still claim 'desertion'?

Option 1: Hai, wife can claim desertion. She can file for divorce on the ground of 'desertion' since she is being forced to live separately from her husband.

Option 2: Nahin, wife can't claim desertion.

Bhaiyo, aap sabhi ko is topik par discuss karna hai. Main aapke saath agree karta hoon ki Hindu Marriage Act 1955 ke grounds for divorce kafi limited hain. Lekin main yeh bhi kahunga ki isse divorce rate ka control hota hai. Maine research kiya hai, aur main aapko yeh batata hoon ki mutual consent ground divorce se related hain, lekin iske baare mein to zyada detail chahiye.
