Hijacking Maintenance Orders

family ailet beginner mcq_help

A common issue is when a person moves to another state or country after divorce. Now, a maintenance order passed in one state doesn't automatically apply in another. But how does the law work around this? Here's a question based on this scenario:

A person (X) gets a maintenance order of Rs 10,000 per month in Delhi (State A) against his ex-wife (Y). Y has now shifted to Maharashtra (State B). X still wants to enforce the maintenance order. What would be the possible next step for X?

A) Apply for registration of the maintenance order in Maharashtra B) Appeal against the order in Delhi courts C) File a fresh case for maintenance in Maharashtra courts D) Lodge a complaint with the Central Home Ministry

What's your answer and why? (And yeah, I tried this one too... thought C would do the trick, but that's not how it works)

Bhai, Maintenance Orders hijacking ka issue serious hai. Yeh toh ek type of abuse of process hai. Court ke order ko breach karke, dabaav ki situation create karke, jo bekarari ki sambhavana hain. Har case ke hisaab se different solution hota hai, par general, victim ko police complaint file karke aur court mein petition file karwane ki zaroorat padti hai. Aur, haan, court ke order ke adhikar se hi action le sakte hain.

Yaar, maintenance orders kisi bhi case mein bahut sensitive subject hain. Main samajh sakta hoon ki aapne kya kehna chahte hain, lekin hijacking ke baare mein baat karne se pehle humein court proceedings, laws aur procedures ka dhyan rakhna hoga. Section 125 CrPC kya kaha hai? Maintenance orders kaise enforce kiye jate hain?

"Bhaiyya, mere vichar hai ki Maintenance Orders ke hijacking ko lekar sabse bada sawal yeh hai ki maintenance wala order ka enforcement kaun kartaa hai. Agar iska enforcement police aur magistrates ko ho to yeh hijacking toh ho hi jaaegaa, kyunke woh log apne vajah se hi isko nahi poore kar rahe hain.

Ye sab correct hai, hijacking maintenance orders koi bhi case mein ho sakta hai jahan par ek side apne benefit ke liye dusre ki maintenance karne wali order ko use karne ki koshish karta hai. Ismein civil court, family court aur HMA (Hindu Marriage Act) ke under ki maintenance orders sabhi shamil hain.
