Gujarat HC Orders Police to Delete Accidental WhatsApp Chats

jurisprudence cuet_pg advanced news_to_law

Yeh to kya Section 22 ya 23 ka case hai. Gujarat HC recently ordered a police commissioner to delete all WhatsApp chats that were accidentally shared with a journalist. The cops claimed that these chats were confidential and shouldn't be shared, but the high court said that since the chats were shared accidentally, they lose their confidential nature.

Aapke gyaan mein hai ki confidentiality kya hai? Vah wahi hota hai jab information aise share ki jaati hai jo ki public nahi hone chahiye. But, if that information aise share hoti hai jo ki accidental the, toh vo confidentiality loss karta hai. Yeh exactly Section 22 or 23 ka case hai. Ye sab kuchh Jurisprudence mein aata hai.

Gujarat HC Orders Police to Delete Accidental WhatsApp Chats

Court case point here: privacy rights of citizens, especially in sensitive info shared on WhatsApp by mistake. HC order says police should delete such chats, if shared out of compulsion or mistake, as per section 79 of IT Act, 2000. Important takeaway: accidental sharing is not a crime. Police will now handle case keeping privacy in mind. This gives a sigh of relief for people sharing sensitive info online.

Main to yeh order ke khilaf sahi nahin hoon. Gujarat HC ki yeh order kuch logon ko aazadi dete hue bhi privacy ke adhikar ko kamzor karti hai. WhatsApp chat delete karne se pata lagta hai ki polisi investigation ki jaanch ke baad bhi private data ke upar nazar rakhti hai. Yeh theek nahin hai.
