Family Law is a total Bummer for Women

I know, I know, everyone says it's progressive and empowering, but trust me after my internship, it's a total joke. In theory, the Indian law provides for gender equality and protection of women's rights, but in practice, it's all about who can pull the strings โ€“ money, power, or social status. I've seen cases where women are expected to prove 'adultery' to get maintenance, and if they can't, they get nothing. What about the women who are victims of domestic abuse or are stuck in abusive marriages because they have nowhere to go? In law school, we focus on landmark judgments like Vishakha vs. State of Rajasthan (1997) and Christian Community vs. State of Kerala (2011), but what about the women who don't have a Vishakha or Christian Community to back them up? It's all about the haves and have-nots in Family Law.

Bummer, indeed! From my understanding, family law in India is highly patriarchal. The laws favour men in most cases, especially in matters like divorce, property rights, and alimony. Women often struggle to secure justice, leading to more 'doli vada' (a common loophole in the law) cases. We need a more women-centric approach for sure.
