Family Law: Can't Digest the Concept of Maintenance
family clat_pg advanced exam_panicMain baap, I'm really losing it. 3 days left for the exam and I still can't grasp the concept of maintenance in Family Law. I've read the bare act like 3 times, but whenever I see a question on section 125, I freeze. "Maintenance is a monthly allowance awarded to wife or child for their maintenance... but how is it calculated? Is it only for wife or child? Can I deduct this from wife's alimony?"
I've studied the case laws, from Sarla Mudgal vs. Union of India to Naveen Kohli vs. NEERAJ KUMAR, but I still get confused. "Section 125 is not a substitute for section 25 of the Hindu Marriage Act... but what does that even mean? Can anyone explain it to me like I'm 5?

I don't think we can say maintenance can't be digested, yaar. Maintenance is a vital concept in family law, ensuring the economic well-being of the dependent spouse/child. Without it, vulnerable family members may face poverty and exploitation. It's not just about 'giving' money; it's about recognizing the value of care and support. The concept is imperfect, but it's a necessary safeguard.
