Evidence Act vs BSA: MH CET Law Dilemma

evidence mh_cet_law beginner poll_style

In MH CET Law, a section of students has been struggling with the application of Evidence Act and Bombay Stamp Act (BSA). Here's a scenario: A person X dies intestate and leaves behind a will, which is duly registered under the BSA. However, the BSA registration is incomplete, lacking a crucial witness signature. Can X's will be admitted as evidence under the Evidence Act? Option A: No, because the will doesn't meet the BSA's witness requirements and thus can't be considered valid. Option B: Yes, since the BSA is a separate Act governing registration, it doesn't affect the will's admissibility under the Evidence Act. Which option is correct, and why?

Kya question hai (what's the question)? MH CET Law ke liye ek confusion hai (a confusion) between Evidence Act aur BSA. Bhai, don't worry, maine samajh liya hai (I've understood). Evidence Act ke sections 59 aur 65 relate hain BSA ke sections ko. Yeh dono laws ek saath aate hain, lekin BSA ka focus court evidence ke production par hai. MH CET Law ke liye focus BSA par rakho, aur Evidence Act ko secondary consider karo.

Saala, yeh dilemma toh bahut serious hai! Ab Evidence Act ke rules ke baad, BSA ke rules bhi aaye hain. MHNKEET ke liye, BSA ke rules apply karte hain. Lekin MH CET ke liye, Evidence Act ka section 58A hai, jo BSA ko override karta hai. So, confuse hone ke baad bhi, yeh clear hai ki MH CET ke liye BSA ka rule hoga.

Maine bhi MH CET Law ke liye apply kiya tha aur abhi evidence act aur BSA me confus ho raha hun. Mujhe lagta hai ki hum dono books ko equal importance dena chahiye. BSA ke liye legal max achi hai, lekin evidence act ke liye Mulla ki bari kitab hai. Sabse important hai ki aap apne concepts clear karte rahen, iske liye naye questions kahein aur practice karte rahen. All the best!
