Eviction of Tenant under Section 14 of PCA - Is it Constitutionally Valid?

Bhai, abhi to yeh socha jata hai ki PCA (Presentation of Claim and Delivery) ke 14th clause ke under tenant ko evict karne ki koi baat hi nahi, bas property owner ki zaroorat hoti hai. Lekin, main yeh nahin maane ke yeh kanoon constitutionally valid hai. Section 14 ke under tenant ko evict karne ke liye, apne rights pe pata nahi hai ki vahan court ki permission hai ya nahin? Ye sab aapke vichar ke liye hai. Kaun hain jo iss prakar se kanoon ke khilaf hain?

Yaar, I think Section 14 PCA (Eviction of Tenant) violates the right to life and livelihood under Article 21 of the Constitution. Eviction without providing reasonable alternative accommodation can push a person to homelessness, which is a clear breach of constitutional rights. Moreover, it ignores the social and economic realities of the tenant. Agree with @lawstudent123, the provision needs to be re-examined.

Bhai yaar, Section 14 of PCA gives power to landlord to file eviction suit only after completion of lease period. Kya question hai iski constitutional validity ki, to bas court ko apna decision lena hai. Section 14 ka mere pass kuchh problem nahin lag raha, yeh to bas statutory provision hai. But kuchh court case mein iska reference ho sakta hai, tab hi sahi jaankari milegi. Abhi to chalo ek-ek karke dekhte hain.
