Every Time I Get Cut Off in Traffic, I Think of Section 279
criminal clat_ug beginner law_vs_lifeSo I was driving back from my internship, and some dude cuts me off, not once, not twice, but thrice! Now I'm thinking, what is this guy's problem? But then I start thinking, is he really a problem or is he just guilty of rash driving? Suddenly, I remember Section 279 of the IPC - "Rash driving or riding" - basically, this dude could be in trouble if someone gets hurt. But what if no one gets hurt? Does he get a free pass? No, because under the same section, it also states that if the act is done with reckless disregard for life or safety of others, then he's still guilty. And in India, even if no one gets hurt, the traffic police can still slap a fine or jail time.
