Dowry Death: Sufficient Ground for Murder Conviction Under Sec 302 IPC?

criminal clat_ug intermediate discussion

Bhai 3 saal se ye hi padh raha hoon, abhi tk nahi aaya IPC mein khush hai. Is topic pe kya aapke vichaar hain? Yeh sawal yeh hai ki dowry death ke case mein, kya abhi bhi murder ke liye sufficient ground hain jo 302 IPC ke under koi bhi conviction ka baaz na ho sake?

Main to yeh kehna chaahta hoon ki haan, sufficient ground to hain. Agar apne pati ke aapko maara jaata hai aur phir aapke jivan ke liye koi nakaam hokar, yeh ek murder hai jo 302 IPC ke under conviction ka baaz ho sakta hai.

Aapke kya vichaar hain?

Additional Info: "Bilkis Bano vs. State of UP (2004) established that dowry-related deaths are sufficient for murder conviction under Sec 302 IPC. In this case, the SC held that a dowry-related death can be presumed to be due to dowry harassment. Therefore, even in absence of direct evidence, prosecution can rely on circumstantial evidence and presumption to prove murder, making dowry death a strong ground for Sec 302 conviction."
