Doubt in Trespass to Land

torts clat_ug beginner mcq_debate

My friend Rohan and I were discussing this MCQ, but we can't agree on the answer. CLAT UG aspirants, help us settle this!

Question: A landsowner constructs a fence on the boundary of his land, over a metre into his neighbour's land (B). This is an example of:

A) Trespass to Land B) Trespass to Person C) Privett's Case (Nuisance) D) Nuisance (Public)

Rohan says it's a) Trespass to Land because A's action involves actual physical invasion of B's land. He quotes Visakha case, "actual physical entry" is a requirement for trespass.

I disagree. According to Pollock & Mulla, a trespass to land occurs when there is an actual entry onto the land or an interference with the possessor's exclusive possession.

Bhai, I'm totally with you on this one. Trespass to land can be super confusing, especially when it comes to public vs private spaces. I think we should also consider the case of Rylands v Fletcher (1868) to understand the concept of strict liability in this context. Have we discussed that in class yet?
