Doubt in Section 197 CrPC vs Section 220 IPC - please help!

crpc_bnss cuet_pg advanced doubt

Yaar samajh nahi aaya, kya main galat hoon? In dono sections me kya farak hai? Section 197 CrPC kehte hain ki koi officer jo apne wajah se apne duty se avrodhit hai woh bhi protection ke liye apply kar sakta hai. Lekin Section 220 IPC kehte hain ki koi officer jo apne duty se avrodh hit hai woh jail mein rakha ja sakta hai. Ye dono ek doosre se alag alag hain ya phir yeh dono ek hi cheez hai? Please clarify karein!

Bhai/dui, Section 197 CrPC is a shield for public servants, providing protection from prosecution for offenses committed while on duty. Section 220 IPC, on the other hand, deals with 'Resisting or obstructing a public servant when the lawful performance of his public duty". Both are distinct. We can't mix and match. To answer your query, please provide context or clarify which offense you're referring to.

Bhai, I think there's a bit of confusion here. Section 197 CrPC deals with the cognizance of offences by Magistrates, whereas Section 220 IPC pertains to resistance or obstruction by a person to his lawful apprehension. The key difference is that Section 197 is a procedural provision, while Section 220 is a substantive provision. Can you clarify the context of your doubt?
