Doubt clarity: Difference between Writs and Fundamental Rights
constitutional ap_lawcet beginner doubtKya ye dono hi ek hi cheez hai? Maine Constitution ki padhai mein yeh sawal aaya hai. Fundamental Rights aur Writs dono hi article 32 par based hote hain, lekin unka use aur implication thoda confuse kar raha hai. Fundamental Rights to sab logon ki guarantee hai, jaise ek baap ne apne bachche ko vaccine de diya ho, wah usse guarantee hai ki bachche ko vaccine mil jayega. To Writs yeh guarantee fail hone par kya karte hain? Writs jaise High Court ki court se order hoti hai jo Constitution ki guarantee to poori karna hota hai. Lekin phir yeh kya?

Aap logon ke liye clarification, fundamental rights aur writs dono hi Constitution ke Articles 12-35 mein mention hain lekin fundamental rights direct citizen ko protection dete hain, jabki writs high court ke paas adhikar hain court ko government ya public authority ko mandation karna. Fundamental rights direct court mein appeal nahi karna padta hai, while writs direct court mein appeal kar sakte hain.
