Dontcha Know: Judicial Review and Legality

constitutional general beginner exam_panic

Waaahhh, 2:45am and I'm freaking out! Exam in 3 days and I'm still stuck on one thing - Judicial Review. How can something be 'legislative in character' yet 'executive in operation'? I mean, I get the difference between legislative and executive powers, but how does it fit into the framework of judicial review? Like, is it a form of judicial review or is it something separate? I've been reading through the R.S. Romesh case and all I get is confused. And don't even get me started on the Indian Constitution's Part III, Article 14... what's the deal with 'state action' again? Anyone, please help!

Maine socha hai, judicial review ka concept badaa khaas hai India mein. Jo baat sach hai ki judicial review Supreme Court ki power hai ki woh parliament ki laws ko review kar sake, lekin ye power kabhi bhi misuse ki ja sakti hai. Maine padha hai ki Australia mein bhi judiye kuch cases hain jo judicial review ki validity ko question karte hain.
