I saw it happen with my batchmates, they were so caught up in memorizing sections, they forgot to understand how it all fits together. Section 3 is a trap, it's all about the presumption of regularity, don't just remember the exceptions, know when the presumption kicks in, it's not just about the 'burden of proof'. Read the judgements, see how the courts apply these principles, don't just mug up, understand. And for BSA, don't even get me started on how judges love to test your understanding of the 'scope of inquiry'

Maine bhi apne saathiyon se suna hai ki Section 3 of JAB (Just and Beautiful) kaafi bada issue hai, karna ki isse humare case ki sabse badi samasya ban sakti hai. Lekin, mere khayal me, agar hum Section 3 ko theek se samajhte hain aur saavdhan rahte hain, toh hum isse pehle se hi harne ki zaroorat nahin hain.
"Agar aapko JAB ki Section 3 ke karan pareshani ho rahi, toh yaa to kuchh aur dhyaan rakhiye. Section 3 ka mudda hain ki yadi koi vyakti koi aise vishay par gana ya abhigyaan likhta hai jo wapas kiya ja sakta hai, to uska adhikaar hai.
Arre, this section ka concept to understand hoga. Jab JAB's Section 3 pehle aaya, to uska matalab yeh tha ki yadi koi kaam karke dukaandaar ko nakaara jaata hai, to unke paas Section 17 ke adhikar se court ke paas apni protection ke liye jaane ka adhikar hota hai. So, yeh koi bhi cheez nahi hai jo aapko Section 3 ke adhikar se rok degi.
