Doctrine of Adverse Possession: When the Neighbour Becomes the Owner
property du_llb advanced analogy_postImagine you're a huge Shah Rukh Khan fan, and you've been watching the same spot outside the cinema where you watch his movies every Friday. You've been sitting there for years, always making a spectacle, and some theatre-goers might even think you're an employee of the theatre!
Now, let's say the cinema owner never told anyone that the spot in front of the cinema is actually a 'no-sitting zone'. You started sitting there without knowing it was restricted, and over time, people start thinking the spot is yours (though technically, it's not). If you continue sitting there for years, and the cinema owner never says anything, you might become the 'owner' of the spot by adverse possession (Article 63 of the Limitation Act, 1963).

"Maine sochha hai, doctrine of adverse possession kitna bhi achha nahi ban sakta hai. Yadi koi apna ghar chhodkar dusre ke ghar mein 12 saal rahne lagta hai, toh usse owner banne ka adhikar kaise milta hai? Yeh samajh mein nahin aata kya unhone koi property ka upyog kiya, unhein tax dene pade, ya phir unhone koi improvement kiya?
