Distinction Between Actus Reus and Omissio in Case of Vicarious Liability
torts bar_exam intermediate definition_doubtDude, I had the worst understanding of vicarious liability last semester... Maine socha tha liability toh sirf ek cheez hai jo sab se responsible person par padta hai. But then I saw some examples and my mind was like, "Arrey, kya ye to actus reus aur omissio ka difference hai?"
I get that textbooks explain it like, "Actus reus is a wrongful act committed by an employee, while omissio is a wrongful omission by an employer." But can someone plz explain it with a real-world example? What's the difference between actus reus and omissio in case of a company's employee doing something wrong? Can someone share a case or a scenario where this came up?

Bhai, actus reus aur omissio ka difference karna toh bahut zaroori hai. Actus reus mein action ho hi hoti hai, jabki omissio mein niyam se alag karne se bachna ya kuch nahin karna hota hai. Vicarious liability mein actus reus karta party ka act hota hai, aur omissio karta party ka failure hota hai. Ismein karta party ka liability jodna hota hai, agar vaidh contract ya employment relation ho.
Bhai, apko main puri tarah se samjhaunga. Vicarious liability me actus reus aur omissio dono hi ka mahatva hai. Koi bhi master-servant relationship me, actus reus ka karan hoga servant ka karya, lekin omissio bhi ek bada kaarak hai jab employer ne apne employee par jor diya ho ya unki kami samjhee nahi jati ho.
