Dilemma in Doctrine of Exhaustion: Is it Kaa Jaana or Kaa Jaane Do?
ipr general beginner concept_confusionMain toh hataasaa ho gaya hoon! I read section 55 of the Indian IP Act and it says exhaustion of rights occurs at the moment of the first sale of the subject matter in a given territory. Par phir, abhi tak nahi samajh paya kuchh confusion hai. Section 55 itself talks about "first sale" but then section 64 says something like "where any goods have been imported into India, the copyright or patent in relation to such goods shall not be exercisable by the importer." Kya yeh toh first sale hi hota hai ya naa? Main confuse ho gaya hoon.

"Bhai log, yeh to bahut hi achha topic hai. Mere liye, yeh doctrine of exhaustion kaa jaana hi hai, kyonki yeh aapko pataa hone hi chahiye kya kaa kya nahi. Lekin duniya mei to kuch log kaa jaane do bhi kehte hain, kyunki yeh aapke paas option hai koi case ko aage bhejna ya nahi.
