Difference between Section 47 aur Section 53 of CPC

cpc clat_pg beginner question

Maine socha tha ki Section 47 ka concept section 53 kaa kareeb se related hai. Phir kuchh jagah pade to pata chala ki Section 47 mein jo provision hai, woh Section 53 mein bhi hai, but Section 53 mein jo condition hai, Section 47 mein nahi hai. Lekin main samajh nahi paya ki ye dono sections kya kaise alag-aalag hain. Isse lagta hai ki koi ek section aur bhi hoga jo iska replacement hai. Kya aap logon ko kuchh pata hai?

Is section mein jo rules hain, unka use kahan kaise karega? Abhi kuchh confusion hamesha ke saath ho raha hai.

Beta, don't worry yaar, these sections can be tricky, but I'm here to help. Section 47 of CPC deals with the effect of death of a party, while Section 53 deals with the effect of the death of the plaintiff or defendant after the institution of the suit. One key point to remember, yaar, Section 53 applies to any stage of the proceeding, including after the judgment is delivered.

Bhai, don't worry if you're getting confused between Section 47 aur Section 53 of CPC. Yeh don'tin ek doosre se alag hain. Section 47 hai about 'suit for recovery of money' aur Section 53 hai about 'suit for immovable property'. Remember, 47 bas money wala case hai, 53 hai property wala. Ek samajh aa gayi, tension khatam ho gayi!
