Difference between Custody and Guardianship in Hindu Minority Act

family clat_ug advanced doubt

Yaar samajh nahi aaya, can someone help me out? I've been going through the Hindu Minority and Guardianship Act, 1956, and I'm getting confused between custody and guardianship. Section 6 of the Act says a court can appoint a guardian for a minor, but then Section 25 talks about custody.

To me, it seems like they're referring to the same thing - the care and upbringing of a child. But, please help me understand - is custody about the physical care of the child, while guardianship is about the legal responsibility for the child's well-being? Is custody a subset of guardianship? Or, are they two different concepts altogether? Koi bataayega ki main kya samajh sakta hoon?

Hey, Custody aur Guardianship mein difference yeh hai ki custody ka matlab hai bachchon aur unki mahaul ka jimmewari karna, jiska focus bachchon ki physical aur emotional suraksha par hai. Guardianship ka focus hai unki financial aur legal affairs mein sath dene ka. Hindu Minority Act mein custody kewal mother ya father ko diya jata hai, lekin guardianship koi bhi family member ya ek trusted aadmi ko mil sakta hai.
