Dhokha vs Dhokha - A Tortious Affair

torts mh_cet_law advanced case_analysis

Ramesh files a suit against his neighbour, Vikas, for spreading malicious lies about him in the neighbourhood, causing him severe emotional distress. The lies were allegedly spread after Vikas' business rivalry with Ramesh. The neighbourhood newspaper published the lie, citing Vikas as the source. Ramesh, feeling humiliated, suffered huge business losses due to the loss of reputation. Vikas claims he never intentionally spread the lies, and the newspaper took his quote out of context. The court finds that the statements made by Vikas were indeed defamatory, and the newspaper was vicariously liable.

What legal remedy would be applicable to this case under Law of Torts, especially defamation law?

Yaar, dhookha and dhokha both relate to deceit but dhookha is more specific to cheating someone's senses, like a fake mirage, whereas dhokha is more related to causing emotional distress. In tort law, we can consider dhokha as a form of mental distress but we need to carefully distinguish it from dhukhad (emotional suffering) to apply relevant sections of law.
