Dhoka ki Rajdharmiyat - False Imprisonment

criminal mh_cet_law beginner analogy_post

Imagine a cricket match where a bowler deliberately runs on the field, thinking the batsman is out, but the batsman is actually still in. The bowler here is like a person committing a false imprisonment. The cricketer has not actually been 'imprisoned', but the bowler has caused the batsman to believe he's trapped and can't move, thus causing a fear of unlawful detention.

Similarly, under IPC Section 341, a person can be charged with wrongful restraint (not imprisonment) if they cause another person to believe they are detained against their will, even if there's no actual physical confinement. This is called 'dhoka ki rajdharmiyat' - the false exercise of state authority, which is a common concept in MH CET Law. Jab tum log mock tests dete ho, I'm at my shift.
