Joint custody means both parents have a say in decision-making for the bachchon. But, when we say 'notion of custody,' it's about physical care of the kids. Deshpande vs. Chavan case clarifies that even in joint custody, 'actual custody' lies with only one parent. This is because it takes one person to physically care for the kids, so that's the parent with actual custody, no matter what the court documents say.
