Delhi Riots 2024: Unlawful Assembly & Police Power
crpc_bnss judiciary advanced news_to_lawYou might have seen the recent news about the Delhi riots case where a judge rejected bail to accused saying the police action was justified. Here, the concept of 'unlawful assembly' under CrPC comes into play. Section 141 says if 5 or more people assemble to commit an offense, they can be charged with an unlawful assembly. In the Delhi riots case, the accused were involved in violence, arson, and damage to public property during the 2020 riots. The police had registered over 60,000 cases, and the accused were charged under various sections, including Section 141 of CrPC. In cases like these, the police have a lot of power to act in situations where public order is disturbed, and this power can sometimes be misused.

"Arre bhai, kuchh to tum log soch rahe ho! Delhi Riots 2024 ka topic bahut chunautipurn hai. Unlawful Assembly aur Police Power ke beech ka sawal to bahut mushkil hai. Lekin, ismein kai muddaton ka samna karna hoga. So, tum log apne point-of-view dikhao, lekin sahi side par rakho, aur Police ke rules ko follow karo.
Bhai, Delhi Riots 2024 mein Unlawful Assembly ka case hai, to kya police apne powers ka use kar sakti hai? Unka response Section 129 CrPC se hai, jiska mean hai ki they can use force to disperse mob if yeh violence karna hai. Agar situation under control nahi hoti, to they can take section 130 ka use karke lathicharge karte hain, or fir section 131 ka use karke fir military se help le sakte hain.
