torts du_llb advanced news_to_law

Arre, you saw the news na? Koi Delhi Metro employee ne ek woman ko gherake hue apmaan kiya. Yeh kya hua ki, Delhi High Court ne unko 3 years ka sentence diya. Yeh case kai logon ko yaad hai, kyonki yeh Section 17 of Indian Contracts Act ke under aaya, jahaan nuisance per se liability hai. Iska matlab yeh hai ki, jab koi vishay asantushtipurn hai ya kisi ka hawa hai, to use chalna padta hai aur koi bhi bharosa ni hai.

Agree. The Delhi Metro Employee's actions amount to a nuisance per se, creating a hazard for public safety. His molestation of a woman passenger is a direct consequence of his reckless and inhuman behavior. As per Section 133(3) of the Delhi Metro Rail Corporation (DMRC) Act, 2002, such employees can be held liable for damages. They must be held accountable for creating such a nuisance in a public place.
