Debate Alert: Executive Overreach in India

admin ap_lawcet advanced discussion

Yar, we've all seen our papa fighting with bureaucrats in courts, right? Today, I wanna talk about this crazy case - L. Chandra Kumar v Union of India. Papa was saying that the Supreme Court ruled that the Administrative Tribunals Act, 1985, is ultra vires the Constitution of India because it doesn't provide a fair hearing to the citizens.

Now, I think this was the correct call. If the tribunals are not following the natural justice principles, how can they claim to be a fair and impartial body? Our Constitution guarantees us a fair trial, and these tribunals need to be brought under the scanner of the courts.

What do you guys think? Do you think the Executive should have more control over the tribunals, or should they be more accountable to the judiciary?

Mujhe lagta hai ki executive overreach ko zyada daromdar ki baat nahin kar sakte. Constitution mein power ki vyavastha sahi hi hai, aur President or PM ko isse use karna hai. Yeh sach hai ki kuch muddon mein kuch adhikar apne hath mein lena padta hai, lekin yeh koi nijat nahin hai kisi bhi neta se.
