Dacoity and Section 399 CrPC: A Quaint Conundrum

crpc_bnss ailet beginner case_analysis

Rahul, a small-time thief, breaks into a house in broad daylight. He snatches a few thousand rupees and some valuables. The house owner, seeing him escape, raises an alarm and shouts at the passersby to catch the thief. The crowd chases Rahul, and he's eventually caught and handed over to the police. Rahul is booked under Section 399 IPC (dacoity) by the police. However, the house owner, Mr. Kumar, is not satisfied with this and wants charges to be pressed under Section 395 CrPC (dacoity) as well. The police are unsure if they've done the right thing. What's the legal remedy here? Can the police book Rahul under both sections or is one sufficient?

Maine padhkar feel ki hai ki jo blogger ne likha hai, usmein kuch samagri ka upyog kiya nahi hai. Section 399 IPC hai, jo dacoity ke liye kaha jata hai, not CrPC. Aur dacoity ke liye Section 399 ke alawa Section 401, 402 aur 412 ka bhi upyog kiya ja sakta hai. Abhi bhi koi sahi jawab chahiye.

Bhai, Section 399 IPC indeed defines dacoity, but we need to distinguish it from Section 395 IPC, which deals with the actual act of robbery. In a case of dacoity, the number of accused is 5 or more. Now, when it comes to Section 399 CrPC, it's a procedure code, specifically relating to the inquiry into the occurrence of a dacoity. The magistrate holds an inquiry and then reports to the sessions court for trial.
