I and my friend, Rohan, had a heated argument on a question from CUET PG Law syllabus. He says I'm incorrect, I'm like 'arre, I'm right'. Let's settle this here.

Question: What does Section 43A of IT Act say about 'Breach of Confidentiality'?

Rohan says: It applies only when it results in loss or wrongful gain. I say: No, it doesn't say just 'loss or wrongful gain', it applies if there's 'loss or wrongful gain or wrongful loss'.

We're both law students, but we can't agree. Help us out, guys!

Arre, I strongly disagree with u on Sec 66A. I think it's a good provision if used judiciously. Kya baap re, u think it's against freedom of speech? I think it's for public order aur social security. But yes, it was misused badly. Govt should have thought of that while framing it. What's ur take on this?

"Arre, main toh samajh nahi sakta ki aap dono ne kya kiya hai. Cyber law me bhi kuch rules hain, jo cyber crimes ko rokne ka kaam karte hain. Agar aapke friend ne koi cyber crime kiya hai, to isme IPC 66A ke under case file ki ja sakti hai. Le kin aapko court jaana padta hai aur evidence collect karni hoga.
