Culpable Homicide v/s Murder: When to use what?

criminal clat_ug advanced doubt

Yaar, mujhe to pata hi nahi ki Contract law hi kahan gaya jata hai, lekin yeh dono terms mere dil mein bhoonta bhoonta rehte hain. Maine pehle samajhne ki koshish ki hai ki kahan contract khatam hone se pehle aur kahan contract khatam hone ke baad hua hai murder, aur yeh saari baatein criminal law mein aati hain. Lekin phir bhi, yeh to clear nahi hai ki kahan culpable homicide aur kahan murder ka use karna chahiye. Maine socha tha isse sahi samajhne ke liye kafi practice problems karke sahi hokar jawaab de sakta hoon, lekin phir bhi, yeh to confuse baaki hai.

Bhai, great question! So, the difference between culpable homicide and murder lies in the intent. Culpable homicide (Section 299 IPC) is when there's no intention to cause death, but it happens. Murder (Section 302 IPC) is when there's intention to kill, or intention to cause serious harm, which ultimately results in death. The key is intent, bro.

"Mehndi hai ye dono crimes to koi bhi serious hain, lekin fir bhi humko difference batana hai toh Murder aakramik hi hota hai, jab police kaa maann hai ki victim kaa maut aapne intention se hua hai. Culpable Homicide jab aapne intention naa hui hai lekin aapne aapka action se koi nuksaan hua hai, jaise aapne road pe bike chalati thi aur someone ko marr diya.
