CrPC Section 154: PolICE Report
crpc_bnss cuet_pg intermediate pyq_discussionI found this CUET PG Law question really tricky last year. It was something like: "Under CrPC Section 154, can a police investigation be concluded when the complainant retracts their complaint after making an FIR, and the witness also denies their statement?" I was like, "Kya hoga, yaar?" It's all about understanding CrPC's concept of 'satisfaction' of the magistrate under Section 176 and how it relates to the police's role in the investigation.
The correct approach is to understand that once an FIR is lodged, it's not just the police's word against the complainant's. The magistrate has to be 'satisfied' that a cognizable offense has been committed. Section 154 is actually about the police's duty to investigate and make a report, not to decide the case.
Bhai, don't worry about CrPC Section 154. It's not that complicated. The police report is a mandatory step after FIR (First Information Report) is registered. It's an initial investigation to gather facts. Just remember, it's an ongoing process, and the police have to follow the procedural guidelines. Keep practicing, and you'll master it. All the best!
Kabhi koi bhi complaint lodge karta hai to uska report FIR mein convert hone ke baad hi lagta hai. Lekin CRPC Section 154 ke under, police aapko report dena padta hai. Is report mein aankdon, jagah, shikaayat ke vishay aur anya detail hote hain. Police ke paas report ke baad FIR lagane ke liye 15 din hote hain. Agree, is section ne FIR system ka mahatvapurn roop dhundhya hai.
