Hey, this is a crucial question for all of us. While both CrPC Sec 138 & IPC can be applied in cheque bounce cases, I'd say IPC Sec 420 (cheque dishonour as criminal breach of trust) is often a preferred choice in cases where the payee has a reasonable trust in the drawer with regard to the cheque. CrPC Sec 138 is more about the procedural aspect, but IPC Sec 420 can add to the severity of punishment.
