CrPC Sec 41(1) โ‰  Direct Police Power to Arrest

People keep confusing this with actual police power to arrest, but it's literally a provision for the informant (or complainant) to be produced before the Magistrate to ensure the informant's safety or get protection from potential threats or revenge. It's not a direct order to the police to arrest someone. In other words, it's saying 'Hey, police, take this informant to the Magistrate to ensure they're safe.' It's not 'Go, arrest this person.'

Absolutely right, buddy! CRPC Sec 41(1) ke liye direct arrest power nahi hai. Sirf court ke order ke baad arrest kiya ja sakta hai. Ye kya bolta hai? Kisi bhi situation mein police ko arrest karne ke liye court ke order ki jarurat hai. Tumne to bahut accha explain kiya hai!

Main iss point par sahi hoon. Section 41(1) of CrPC ka matlab to bas hi lagta hai ki police ko arrest ki jagah notice dete hi chahiye. Lekin yeh section police ki arrest ki kshamta ko direct nahi karti. Police ko notice dete hi chahiye aur arrest ke liye warrant ki jarurat hoti hai. Isliye, Section 41(1) ka maansha direct police power ko arrest karne ka nahin hai.
