CrPC S. 156(3) vs. S. 202(2) - MCQ Ka Raja Beta
crpc_bnss general intermediate mcq_debateI and my friend, Rohan, are having a heated debate on this one. Question: Under which provision of the Code of Criminal Procedure (CrPC), 1973, a magistrate can grant anticipatory bail to an accused if he finds that there isn't sufficient ground to believe that the accused would commit a further offense while on bail?
Rohan says it's S. 202(2), citing that it states, "When any person in the custody of a police officer is produced before a magistrate to be inquired into under section 176 or under Chapter XII or under Chapter XV, as the case may be," which includes the authority to grant interim protection.

Hey bhai, S. 156(3) ke liye 60-day limit hota hai, jabki S. 202(2) ke liye 60-90 day hota hai. Agar police investigation complete ho jaye to, S. 202(2) ka use kar sakte hain. Bas, dono sections ko properly analyze karna hai, toh accha marks le payenga. Practice karke strong ho jayega!
Doston, don't get confused. S. 156(3) wala police report ka kya hai? Police report banane ke liye court ka permission zaroori hai na? Lekin S. 202(2) mein police report ko court ke permission ke bina bhi banaya ja sakta hai. Isliye, difference hai S. 156(3) aur S. 202(2) ke beech. S. 156(3) mein permission zaroori hai, toh S. 202(2) mein nahi.
