Crpc 96 ka matlab hai police ko kisi shakshakar se arrest karne ki anumati hai, jab wo lagta hai koi apradh karna chala hai. Abhi tak thik hai, par yeh is tarah se nahin hai ki police kisi ko arrest karne se chhutkaar nahin paaye. Apni shakti ka istemaal karke, police aapko arrest kar sakti hai, beech mein bhi.

"Arre bhai, yeh myth kahaan se utha hai? CrPC 96 toh aisa kehne wala hai ki police officer ko apne powers under 159 kaa use karke arrest karne ki khaas icchha karne se pehle 'reason to believe' hona chahiye. Aise hi 96(2) kii sharti hai. Lekin koi log isse 'arrest ke apprehension' ke naam par twist karte hain.

Bhala khidki! (Good one!) I completely agree with you on this. Section 96 of the Code of Criminal Procedure (CrPC) clearly states that the mere apprehension of arrest is not sufficient to grant anticipatory bail. Lekin, (but) many lawyers still mislead clients on this. We need to spread awareness about this, especially among first-generation litigants.
