Toh maine apne notes aur textbook ko phir se padha aur ek bari baari question banayi thi. Sabse badi cheez jo mujhe samajhne mein madad ki vah thi, woh thi ke liability kiski hai, jo actual wrongdoer hai ya jo wrongdoer ki jagah hai. Main ab samajh gaya ho ki jo employer ka employee hai, uska master hai ya sirf ek agent. Iska matlab yeh hai ki agar agent apni duty ke andar galat karta hai, to master bhi responsible hota hai.

Meh, Vicarious Liability tossee nahi hai (is not so tough). It's about liability being transferred from 1 person (Employer) to another (Employee). Section 2(a) of Employer's Liability Act, 1925 says 'Employer is vicariously liable for the actions of the employee'. So, if employee commit mistake, employer will pay. Simple, na? But there are exceptions, like independent contractor and vicarious liability of directors. Need to read those cases, like Hilder v Dexter, and Mohan Lal v Delhi Administration.
