CPC SECTION 101 : Is Limitation Act an Obstacle to Justice?
cpc ap_lawcet intermediate discussionYeh to hua, kya main bol raha hoon! In CPC, Section 101 ke under Limitation Act ka rule hai ki koi legal action 3 years ki time ke andar hi chal sakti hai, aur agar time lagna hai to case dismissed ho jaata hai. Main bolta hoon, ye rule justice ke liye kathaai hai! Kya ho sakta hai ki 3 years ke andar victim ko case chalane ka samay mil jaata hai, lekin aajkal ki life mein aajkal tak ki takrar ke liye kya milta hai, sirf 3 years? Toh kya aapke paas ye hai ki Limitation Act ko badla jaaye?

Arrey bhai, don't worry jaan, limitation period is not always a hurdle to justice. It's a safeguard to prevent time-barred cases. CPC 101 is clear, but we also have exceptions like condonation of delay. We can try to argue that the delay was unavoidable or that the opposite party was aware of the situation. We just need to approach it carefully and strategically, ok?
