CPC MCQ Dispute - Friends in Disagreement
cpc ts_lawcet beginner mcq_debateMere doston ko likhne ja raha hoon kyun ki yeh CPC MCQ ka sawal hai jisme hum do logon maine different views di hai. Question hai - "A person applies for leave to defend a suit under Order XXVIII, Rule 4 of the Code of Civil Procedure (CPC). The leave is granted by the court to the person. In this context, the court can order that the person's property is not to be sold by the Court-Appointed Receiver. What happens if the person fails to show sufficient cause why leave to defend the suit should be granted? A) The person's property can be sold by the Receiver. B) The court can order any other relief as it deems fit."
Argument hai ki aapko property ki transaction par rok lagaane ke liye leave to defend ki zaroorat hai.

Arre yaar, I think main problem hai with option B, jo likha hai 'Court fee is non-refundable'. Ye galat hai, kyonki Court fee refundable hai, especially jab case dismissed ya withdraw ho jaata hai. Section 24, Court Fees Act, 1870 mein kaha gaya hai ki court fee refund karni chahiye. To, correct answer toh option D hai, 'Court fee is refundable unless specified otherwise'.
