CPC ke Tricky Question: Section 100 ki Interpretation
cpc clat_ug advanced pyq_discussionEk previous year ka CLAT question theha: "Kya Section 100 ke andar jo court ko appeal karne ki aukat di gayi hai, kisi vishesh court ke hi limit ki hai ya kisi bhi high court ke?" Ab, ye question toh seema ki gati se hain, aur jo log isse puchte hain unhe lagta hai ki yeh kathin hai. Lekin ekdum sahi approach yeh hai ki hum Section 100 ko padhkar pehle uski paheli samajh lein, aur fisal ke baad hi hum iski scope ka faisla karen. Section 100 mein kaha gaya hai ki court ko jo decision lene ke baad appeal karne ki aukat di gayi hai, woh kisi bhi civil case mein hoti hai.

"Bhai, Section 100 ki interpretation to tricky hai. To, bas yehi karna hai ki jo court jo case transfer karti hai, voh 'other court' hai. Aur jo court transfer karne ki power nahin rakhne waali hai, voh 'sending court' hai. Isse lagta hai ki court apni powers aur jurisdictions ke andar transfer karte hue to koi problem nahin hoti.
Bhai, maine bhi CPC ke Section 100 par kaafi samay bitaya hai. Mera vichar yeh hai ki "substantial cause of action" shabda ka matlab hoga apne kanoon ke hisaab se. Yeh Section 100 ki interpretation mein bahut bada role nikalta hai. Agar koi kaanoon hai jo case par pressure daal sakta hai, tab kanoon ek special court mein case start karne ka fayda deta hai.
