CPC in Action: A Case that Blew the Lid Off

During my internship at a district court, I observed a case that taught me a valuable lesson about Section 106 of the CPC. A young couple was denied permission to sell off their jointly-owned property in a family dispute. Their argument was that the property should be shared equally between them as per the Hindu Marriage Act, but the court ruled that their joint ownership under the Transfer of Property Act was governed by Section 106 of the CPC, which states that even if there's a dispute, the property cannot be sold without the consent of both parties. The judge made it a point to highlight that this provision doesn't just apply to joint ownership, but also to joint liability. This case made me realize that sometimes, it's the application of seemingly minor sections that can swing a case in a surprising way.
