Copyright Law in India: Is It Time to Make Fair Use a Reality?
ipr ts_lawcet beginner discussionYaar, I'm totally torn between sections 52 and 31 of the Copyright Act, 1957. While I agree that the current provisions are a good start, I strongly feel that India should adopt a more liberal fair use policy like the US. In our country, the concept of 'fair dealing' is woefully inadequate, and it only applies to specific purposes like criticism, review, or reporting current events. But what about satire, parody, or educational purposes? Don't these also constitute fair use?
I'm leaning towards the US model, where fair use is a more nuanced and flexible concept. For instance, take the landmark case of Campbell v. Acuff-Rose Music, Inc., where the court ruled in favor of 2 Live Crew's parody of Roy Orbison's 'Oh, Pretty Woman'. Wouldn't a similar approach in India help promote creativity, innovation, and free speech?
