Contractual Obligations vs. Implied Terms

ipr ap_lawcet beginner trick_question

I'm still reeling from the Contract law paper, and I want to warn you guys about this super tricky question from AP LAWCET. Question was: "Rohan agrees to buy a TV set for โ‚น 10,000 but it is delivered to him. The TV set develops a technical snag after a week. Rohan refuses to take delivery of the TV set and refuses to pay the price. Can the seller recover the amount? Discuss.

Most of us get this wrong - we think about implied terms (i.e., there was no express term about the TV being in good condition) and conclude that the contract is void or that there's a breach of condition. But, guys, it's not about implied terms or conditions or warranties ๐Ÿคฆโ€โ™‚๏ธ. Think about it - Rohan refused to take delivery and won't pay.
