Mere vichaar hai ki minor ko koi bhi contract ki pahachan nahin hone chahiye. Kuch aise case hai jaise Bhagat Ram v. State of U.P (1975) jahan Supreme Court ne kaha ki minor ko contract ka hataf hai, aur usse contract ki poori pahachan nahin hoti hai.

Mujhe lagta hai ki yeh sawal bahut relevant hai. Aap sabhi jante hain ki Section 3 of the Indian Contract Act, 1872 ke anusaar minors ka contractual capacity zero hai. Lekin, kuch hi cases mein, high court ne minors ko contractual liability par bound karne ki avadharan di hoti hai, jaise ki jhansaam case mein.
Bhai, contractual capacity of minors is a big issue. Section 3 of the Contract Act says minors can't enter into contract, but what about those who are 18+ or in some states 21+, do they not have capacity? Or is it just a question of consent? We should also see the concept of 'voidable contracts' - if the contract is voidable, can minors still be bound if they choose to keep the contract? Bilkul confusing topic, saaf karna mushkil hai!
